This Privacy Policy applies to the Ncontracts website and governs data collection and usage. This Privacy Policy may be updated periodically and will be posted on our website, indicating when it was last updated. If there are material changes to our Privacy Policy, we will post a prominent notice on our website or provide other notice as may be required by law.

Children’s Personal Information

Ncontract’s website and services are not directed to, and we do not knowingly collect personal information from anyone under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information, they should contact us. We will delete such information from our files as soon as reasonably practicable.

Information You Provide Us

We may collect information that personally identifies you such as your first name, last name, address, email, phone number and any other information you provide to us that may be used to reasonably identify you (“Personal Information”) when using the various forms on our website, including our contact us form. We collect the Personal Information you provide to us when you request a demo from us or when you choose to use our services. Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Ncontracts' public message boards, this information may be collected and used by others. Note: Ncontracts does not read any of your private online communications.

To the extent we process deidentified personal information, we will make no attempt to reidentify such data.

Information We Automatically Collect

When you visit our website, we may automatically collect certain information about your device, including information about your web browser, IP Address, time zone, access times, and referring website addresses. Additionally, as you browse the website, we may collect information about the individual web pages or services that you view and about how you interact with the website. We generally use this information to operate our services, to maintain the quality of the service, and to provide general statistics regarding the use of the Ncontracts website.

Ncontracts collects and uses your personal information to operate the Ncontracts website and deliver the services you have requested. Ncontracts also uses your personally identifiable information to inform you of other products or services available from Ncontracts and its affiliates. Ncontracts may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Ncontracts may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. Ncontracts keeps track of the websites and pages our customers visit within Ncontracts, in order to determine what Ncontracts services are the most popular. This data is used to deliver customized content and advertising within Ncontracts to customers whose behavior indicates that they are interested in a particular subject area. Ncontracts websites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Ncontracts or the site; (b) protect and defend the rights or property of Ncontracts; and, (c) act under exigent circumstances to protect the personal safety of users of Ncontracts, or the public. How Long We Keep Your Data

We retain Personal Information for no longer than it is reasonably necessary for its processing purpose. The applicable retention period depends on the purpose for which Personal Information was obtained and on specific data retention obligations arising from applicable laws that may require the data to be held for a certain period of time. We may retain Personal Information for a longer period than is necessary if it is required by law.

California Civil Code Section 1798.83 permits users of our website that are California residents to request certain information regarding our disclosure of the information you provide through the website to third parties for their direct marketing purposes. State Privacy Rights

Certain state consumer privacy laws provide their residents with additional rights regarding Ncontract’s use of their personal information. Depending on the state in which you reside, you may exercise certain privacy rights by following the instructions included in the sections below. Please note, this section does not apply to information that is not considered “personal information,” such as anonymized, deidentified, or aggregated information, nor does it apply to financial information covered by the Gramm Leach Bliley Act (GLBA), or publicly available information as defined in applicable laws.

Overview of State Privacy Rights

We offer you certain choices related to your personal data. The choices detailed in this section may not apply in every circumstance and are based on your state of residency. You may have one or more of the following privacy-related rights available to you:

  • Right to Know – The right to request what Personal Information we have collected, used, and the categories of third parties with whom we have shared your Personal Information during the past 12 months. We have made this information available within this privacy notice.
  • Right to Limit- The right to limit how we use or disclose your sensitive personal information.
  • Right To Access – The right to request a copy of the specific pieces of Personal Information we maintain about you.
  • Right to Delete – The right to request that their Personal Information be deleted, subject to some exceptions. Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies.
  • Right to Correct – The right to correct Personal Information that has become outdated or is otherwise inaccurate.
  • Right to Opt-Out – The right to opt-out of the sharing of Personal Information for targeted and cross-context behavioral advertising purposes. In some states, you may also have the right to limit the use of sensitive Personal Information.
  • Right to Data Portability – The right to request that we provide you or another entity with your Personal Information in a readily usable format, as technically feasible.

Exercising Your Rights

To exercise your right to know, request, or delete, we may need to verify your identity to a degree of certainty based on the sensitivity of your request. As required by applicable law, we will seek to verify your identity and state of residence for each request (a “Verifiable Consumer Request”). We will not fulfill your request unless you have provided sufficient information for us to reasonably verify your identity as the consumer about whom we collected Personal Information.

Only you, or someone legally authorized to act on your behalf (an “Authorized Agent”), may make a request to know or delete related to your personal data. We require Authorized Agents to provide written authorization confirming they may submit a request on your behalf. You may only submit a request to know twice within a 12-month period. We endeavor to substantively respond to a Verifiable Consumer Request within forty-five (45) days of its receipt, unless we require an extension. If we reasonably require an extension, we will inform you of the reason and extension period.

Once we receive your request and confirm your identity, we will review your request. We may deny your request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies. If we deny your request, you may submit an appeal. Instructions for how to submit your appeal will be included in our response explaining why we denied your request. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

If necessary to verify your identity, we may ask you to provide additional information that will help us do so. We will only use that additional information in the verification process, and not for any other purpose. If we cannot verify your request, we will not disclose any personal information.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

Right to Appeal a Denial

Certain state laws provide residents the right to appeal decision where we decline to take action in response to a data request. In instances where such right applies to you, you may choose to appeal our decision within 90 days from the date of our decision. You may submit an appeal by emailing us at joseph.mccarthy@ncontracts.com with the subject line “Appeal Data Rights Decision”.

Authorized agents

If you wish to submit a request to know, delete, or opt out through an authorized agent, we require the following before we can process the request:

  • A notarized copy of your written permission authorizing the agent to make the request, and
  • That you verify your identity directly with us.

If your authorized agent has a valid power of attorney under California Probate Code sections 4000 to 4465, we may request proof of the power of attorney instead of the foregoing.

We may deny a request from an agent that does not submit proof you authorized them to act on your behalf.

Non-Discrimination

We will not discriminate against you for exercising any of your data subject rights. We do not charge a fee to process or respond to your Verifiable Consumer Request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

DO NOT SELL OR SHARE MY PERSONAL INFORMATION (RIGHT TO OPT-OUT)

To request that Ncontracts not “Sell or Share Your Personal Information,” please see the section above titled “Exercising Your Rights.” In this case “sharing” refers to a specific type of disclosure under certain privacy laws that relates to advertising activity including targeted advertising (also called “cross-context behavioral advertising”). An example of selling or sharing information is when we disclose information about you (like when you have visited our Site) tied to unique identifiers, like device IDs, with third parties for targeted or cross-context behavioral advertising. When you tell us not to sell or share your Personal Information, we will not disclose your personal data for these purposes. Please note that not all disclosures of your Personal Information constitute a “share” or “sale” of your data under applicable privacy laws.
